حقوق والتزامات صاحب براءة الاختراع

Abstract

إن براءة الاختراع تخول صاحبها مجموعة من الحقوق والالتزامات،منها حق ملكیة الفكرة المخترعة وذلك بإمكانیة التصرف فیها بكل التصرفات المشروعة،كما یملك صاحبها حق استئثار استغلال البراءة وذلك عن طریق الانتفاع وبأي طرق الاستفادة المشروعة وبذلك یمنع على الغیر استغلال أو استعمال طریقة صنع المنتوج المحمي البراءة ، ومن حقوقه أیضا التمتع بصفة المخترع وذلك بذكر أسمائهم في شهادة براءة الاختراع. مقابل هذه الحقوق على مالك البراءة الالتزام بدفع مجموعة من الرسوم ،و یعاقب عن عدم الالتزام بدفعها سقوط البراءة ،غیر أن المشرع خفف ونص على إمكانیة استرجاع ملكیة البراءة ،كما یلتزم أیضا بالاستغلال الكافي و الجدي للمنتج و التوفیر في الأسواق الوطنیة،ویترتب عن عدم الاستغلال الترخیص الإجباري.

The patent confers on its owner a set of rights and obligations and among these rights, the right of ownership and the idea to invent and this is assign the patent, the right to mortgage or authorize to others without use by the ticket of a contract, as it also grants its holder the right of exploitation and exclusive monopoly which prohibits its use by others. And among these rights also enjoy as inventor and mentioned their names in the patent application. In exchange for these rights, the patent holder has the obligation to pay a series of fees, in the case of non-compliance with the payment of the fees he is punished by forfeiture of the patent, But the legislator has softened and provides for the possibility of resumption of the patent. The holder is also committed to the operation, and in the case of non exploitation it is punished by a compulsory license.
