حدود الرقابة القضائية على سلطات الضبط الاداري في مجال الصحة العامة

Abstract

تضطلع الإدارة في إطار ممارستها لنشاطاتها بأعباء عدیدة و متنوعة، حیث یعد الضبط الإداري من أهم هذه النشاطات، ولأنه نظام وقائي بالأساس فهو یستهدف الحفاظ على النظام العام وصیانة الحقوق والحریات الأساسیة في ظل الظروف العادیة أو الاستثنائیة، ولذلك فإن الدولة ملزمة بالتدخل لضبط ومكافحة كل ما یمس بالنظام العام، سواء الأمن العام أو السكینة العامة أو الصحة العامة، وأمام تفشي وباء فیروس كورونا المستجد الذي ظهر في الصین في مدينة وهان فيفري 2020. وعلى غرار باقي بلدان العالم كانت الجزائر ملزمة بالتدخل لضبط ومكافحة كل ما يمس بالنظام العام، خصوصا الصحة العامة، من خلال اتخاذ جملة من تدابير وإجراءات الضبط الإداري ، حيث أن الهدف من إجراءات الضبط الإداري يتمحور حول حفظ النظام العام، فهدا الأخير هو فكرة مرنة و متطورة بتطور الزمان و المكان، بالإضافة إلى أنها فكرة واسعة وشاملة لكل فروع النظام القانوني في الدولة، غير أنها تختلف من فرع إلى آخر و ذلك من حيث مضمونها و إطارها ،أسبابها و إجراءاتها.

Like the rest of the world, Algeria was obligated to intervene to control and combat everything that affects public order, especially public health , by taking a set of administrative control measures and procedures, as the goal of administrative control procedures revolves around maintaining public order, the latter being a flexible and sophisticated idea with the evolution of time and place, in addition to being a broad and comprehensive idea for all branches of the legal system in the state, not It differs from one branch to another in terms of its content, framework, causes and procedures.
