أمن المنتوجات في قانون حماية المستهلك

Abstract

مع إنتشار المنتجات الصناعية في عصرنا وما يميزها من تعقيد وما قد تشكله من مخاطر على مستعمليها ما أدى إلى ضرورة توفير حماية أكبر لفئة المستهلكين بفرض إلتزامات على المتدخلين ويعد إلتزام ضمان السلامة أحد أهم هذه الإلتزامات التي نص عليها القانون 09-03 المتعلق بحماية المستهلك وقمع الغش ولتجسيد هذا الالتزام ذهب المشرع الجزائري إلى وضع ضمانات وفرض قواعد وقائية تهدف إلى تفادي وقوع الضرر وذلك بإلقاء على عاتق المتدخل إلتزامات تكفل سلامة المنتوج تحت رقابة أجهزة الدولة وتوقيع عقوبات إدارية وجزائية على المتدخلين الذين ثبت قيامهم بأفعال مجرمة.
