آلـيات الضبط الإداري لتنظيم منتجات التعديل الوراثي

Abstract

يعالج موضوع الضبط الإداري، أهمية الضبط الإداري كوسيلة للمحافظة على النظام العام بعناصره، من مختلف الأضرار والمخاطر التي قد تهدده جراء النشاط البشري. ونجد منتجات التعديل الوراثي من تلك الأنشطة التي تمس بالنظام العام وتهدده، جراء الآثار السلبية الناجمة عنها. وتتنوع وسائل الضبط الإداري بين وسائل وقائية تمارس قبل مزاولة النشاط، ووسائل ردعية تمارس بعد مزاولة النشاط وهي بمثابة جزاءات إدارية. فالمشرع الجزائري عمل على حماية النظام العام والصحة والبيئة، من مخاطر منتجات التعديل الوراثي، باتخاذ إجراءات متعددة كفيلة للتقليل من هذه المخاطر.

The issue of administrative control deals with the importance of administrative control as a means of maintaining public order with its components, against the various damages and risks that may be threatened by human activity. We find that genetic modification products are among those activities that affect and threaten public order, due to their negative effects. The means of administrative control vary between preventive measures exercised before the activity, and deterrents exercised after the activity, which are administrative sanctions. The Algerian legislature has worked to protect public order, health and the environment from the dangers of genetic modification products by taking various measures to reduce these risks
