Abstract

يتمحور موضوع البحث حول "آثار الأمراض المعدية على عقد العمل" ، حاولت أن أكشف عن الأثر الذي يمكن أن تتركه الأمراض المعدية على أحكام عقد العمل، وذلك ببيان أحكام التعويض التي يستفيد منها العامل في الشريعة والقانون، وقد شملت مذكرتي على ثلاث فصول وقد توصلت إلى مجموعة من النتائج منها: - التحلي بروح المسؤولية، والالتزام بالإجراءات الوقائية قبل وأثناء وبعد تفشي مرض معدي. - ضرورة التوعية للعامل ما له وما عليه من حقوق وواجبات تجاه مهنته، عند تفشي العدوى، أو تعرضه لحادث مهني. - يمكن استعمال القياس في مجال القانون، عند وجود مسائل تدخل تحت نص واحد، وذلك لاشتراكها في دلالة اللفظ والفحوى والمقصود. كما استعنت في مذكرتي هذه للاستدلال على آيات من القرآن الكريم، وأحاديث نبوية من السنة المطهرة الشريفة، منها ما رواه أبو هريرة ،البخاري، مسلم، الإمام أحمد، النسائي، الترمذي، وأبو داوود وغيرهم، بالإضافة إلى بعض كتب الفقه، وكتب القانون، والمعاجم ، والأطروحات، وكتب أخرى.

The topic of the research revolves around “The Effects of Infectious Diseases on the Work Contract.” I tried to reveal the impact that infectious diseases can have on the provisions of the work contract, by clarifying the compensation provisions that the worker benefits from in Sharia and law, and my memoir included three chapters: It reached a number of results, including: Being responsible and adhering to preventive measures before, during and after an outbreak of an infectious disease. The necessity of raising awareness for the worker of his rights and duties towards his profession, in the event of an outbreak of infection, or exposure to an occupational accident. It is possible to use analogy in the field of law, when there are issues that fall under one text, due to their participation in the meaning of the word, the content and the intended. I also used this memorandum to infer verses from the Noble Qur’an, and prophetic hadiths from the honorable purified Sunnah, including what was narrated by Abu Huraira, Al-Bukhari, Muslim, Imam Ahmad, Al-Nasa’i, Al-Tirmidhi, Abu Dawood and others, in addition to some books of jurisprudence, law books, and dictionaries Theses, and other books.
