Abstract

نستخلص من خلال ما درسناه في مذكرتنا تحليل ودراسة شرعية للميثاق الافريقي لحقوق الانسان والشعوب أنها لاتعد من أهم القضايا التي ركز عليها المجتمع وكل هذه الحقوق مبنية على خصائص بين البشر من جانب مما يبرر حماتها الوطنية والدولية ، وبأن حقيقة احترام حقوق الشعوب يجب أن يكفل بالضرورة وحقوق الانسان من جانب اخر ، واذ نرى أن التمتع بالحقوق والحريات يقتضي أن ينهض كل واحد بواجباته .

We conclude from what we have studied in our memorandum an analysis and study of the legitimacy of the African Charter on Human and Peoples’ Rights that it is not one of the most important issues on which society has focused, and all these rights are based on characteristics between human beings on the one hand, which justifies their national and international protectors, and that the fact that respect for the rights of peoples must necessarily guarantee the rights of Man on the other hand, and considering that the enjoyment of rights and freedoms requires that each one perform his duties.
