جريمة التستر على جرائم الفساد في الفقه الإسلامي والقانون الوضعي

Abstract

يهدف هذا البحث إلى التعريف بموضوع التستر على جرائم الفساد، وذلك من خلال الوقوف على مفهوم التستر ، واركانه ، واسبابه ، وانواعه ، ثم بعده التعريج على موضوع الفساد ، و أسبابه ، والجهود المبذولة لمكافحته؛ وصولا الى تجريم التستر على جرائم الفساد ، والعقوبات المرصدة له من خلال احكام الفقه الإسلامي ومقارنتها للقوانين الوضعية وبالنظر لعالمية انتشار ظاهرة الفساد والتي تقتضي عالمية مكافحته، فإن جهودا دولية كبيرة تبذل من طرف العديد من المنظمات الدولية على غرار منظمة الأمم المتحدة، البنك الدولي، منظمة الشفافية الدولية، المنظمة العالمية للبرلمانيين ضد الفساد، من خلال إبرامها لاتفاقيات وسنها للتشريعات التي من شأنها الحد من الفساد. وعلى الرغم من ذلك إلا أن الشريعة الإسلامية كانت سباقة لوضع الآليات والأدوات الشرعية للوقاية من الفساد والحد منه ومكافحته. ولقد توصلت الدراسة إلى أن المشرع الجزائري بذل ولايزال جهودا كبيرة من أجل تعزيز الترسانة القانونية ودعم التدابير الرامية لمكافحة الفساد، وطنيا ودوليا وتعزيز قيم النزاهة والشفافية والمساءلة ومساهمة المجتمع المدني في ذلك ؛ كما قدمت الشريعة الإسلامية جملة من التعاليم والتوجيهات الشرعية المستمدة من القرآن الكريم والسنة النبوية المطهرة، ووضعت التدابير الوقائية والعلاجية للحد من ظاهرة الفساد.

This research aims to define the topic of covering up corruption crimes, by identifying the concept of cover-up, its pillars, causes, and types. In order to criminalize the cover-up of corruption crimes, and the penalties imposed for it through the provisions of Islamic jurisprudence and their comparison with man-made laws, and given the global spread of the phenomenon of corruption, which requires the global fight against it, great international efforts are being made by many international organizations such as the United Nations, the World Bank, the World Bank. Transparency International, the global organization of parliamentarians against corruption By concluding agreements and enacting legislation that would reduce corruption. Despite this, Islamic Sharia was a forerunner in developing legal mechanisms and tools to prevent, reduce and combat corruption. The study concluded that the Algerian legislator made and still exerts great efforts to strengthen the legal arsenal and support measures to combat corruption, nationally and internationally, and to promote the values of integrity, transparency and accountability, and the contribution of civil society to that; The Islamic Sharia also provided a set of legal teachings and directives derived from the Noble Qur’an and the Sunnah . The Prophet's sanctification, and put in place preventive and curative measures to reduce the phenomenon of corruption.
