إثبات الوقف في الفقه الإسلامي والقانون الجزائري

Abstract

اهتم الفقه الإسلامي بأحكام الوقف و وسائل إثباته ، وذلك سعيا منه للحفاظ على الأوقاف من حيث وجودها ونمائها و حقيق المقصد الشرعي من تشريع الأوقاف وهو الانتفاع بها واستغلالها في ما يعود بالنفع على الأمة الإسلامية ، ولقد اعتمد التشريع الجزائري نفس الاتجاه حيث اولى عناية خاصة لوسائل إثبات الوقف وذلك بالنص عليها في نصوص قانونية خاصة ، وذلك سعيا منه للحفاظ عليها وحمايتها ، وإذا كان الفقه الإسلامي اعتمد أسلوب الحصر في مسألة إثبات الوقف وذلك بحصر هذه الطرق في ألفاظ وأفعال معينة ،فإن التشريع الجزائري اعتمد أسلوب التوسع في الطرق التي يثبت بها الوقف، حيث ترك المجال مفتوح أمام كل صاحب مصلحة في إثبات الوقف بكل طرق و وسائل الإثبات الشرعية والقانونية ، ومن هذا المنطلق سعينا من خلال هذا البحث إلى عرض مختلف سائل إثبات الوقف الشرعية والقانونية وبيان مدى انسجامها والوقوف على أوجه الاختلاف فيها ، ومن أجل تحقيق الأهداف المرجوة من هذا البحث اعتمدنا على تقسيمه إلى فصلين ، فصل أول استعرضنا من خلاله التعريفات وتحديد المفاهيم ، ثم فصل ثاني حاولنا من خلاله الوقوف على طرق إثبات الوقف في الفقه الإسلامي والتشريع الجزائري.

Endowment by stipulating it in special legal texts, in an effort to preserve and protect itAnd if Islamic jurisprudence adopted the method of limitation in the issue of establishing the endowment by limiting these methods to certain words and verbs, then the Algerian legislation adopted the method of expanding the ways in which the endowment is established, leaving the field open to every stakeholder in proving the endowment by all legitimate ways and means of proof. and legal From this point of view, we sought through this research to present the various means of proving the legal and legal endowment and to show their consistency and to identify the differences in them. The second, through which we tried to identify the ways to prove the endowment in Islamic jurisprudence and Algerian legislation.
