التجديد الأصولي عند محمد مصطفى شلبي

Abstract

علم أصول الفقه كغيره من علوم الشريعة بحاجة إلى التجديد, وقد أخذ هذا التجديد أشكالا مختلفة, وأنواعا متعددة على حسب نظرة ومفهوم كل داعية إلى التجديد في هذا العلم, فجاءت إسهامات الدكتور محمد مصطفى شلبي في التجديد الأصولي لتوسيع أوعية الاجتهاد وتحريرها من القيود الكثيفة التي وضعها الأصوليون ؛ فحملت في ثناياها أنواعا مختلفة من التجديد; والتي منها التجديد في الكتابة الأصولية, والتجديد في بعض مسائل الأصول ومباحثه, وفيه دعا الدكتور شلبي إلى التعليل بالحكمة والمصلحة، ووسع من أنواع الاستحسان متجاوزا بذلك ما استقر عليه الدرس الاصولي الحنفي، وبرهن عليها بالتمثيل وعضدها بالدليل من الكتاب والسنة وآثار الصحابة وفقه الأئمة، خصوصا منها نوع الاستحسان بالمصلحة وذلك استجابة لحاجات الناس في مختلف الأزمنة والأمكنة، ومهما جدت من مدنيات, وحدثت من أقضية ونوازل.
