البيع بالجزاف في الفقه الإسلامي والقانون المدني الجزائري

Abstract

تهدف هذه الدراسة إلى بيان ماهية بيع الجزاف في الفقه الإسلامي والقانون المدني الجزائري، كما تحدد لنا هذه الدراسة ما مدى مشروعية بيع الجزاف في الفقه الإسلامي والقانون المدني الجزائري، وكذا أركانه، وشروطه، وما يتعلق بهذا البيع، واعتمدت هذه الدراسة على المنهج المقارن، وذلك من خلال مقارنة جل عناصر الدراسة بين الفقه الإسلامي والقانون المدني الجزائري، وفي الختام توصلت هذه الدراسة إلى أن بيع الجزاف أصبح من البيوع التي قد لا يستغنى عنها في وقتنا الحالي، وذلك لحاجة الناس إليه، كما توصلت هذه الدراسة إلى أن بيع الجزاف يعتبر بديلاً إسلامياً لكثير من البيوع المالية المعاصرة الفاسدة، وكذلك توصلت هذه الدراسة إلى أن بيع الجزاف كفيل برفع الحرج والمشقة وينقل المتبايعين إلى دائرة السعة وذلك عند تطبيقه تطبيقاً سليماً.

This study aims to show what the sale of haphazard is in Islamic jurisprudence and Algerian civil law, as this study shows us the legality of the sale of haphazard in Islamic jurisprudence and Algerian civil law, as well as its pillars, conditions, and related to this sale, and this study relied on the comparative approach, by comparing most of the elements of the study between Islamic jurisprudence and Algerian civil law, In conclusion, this study concluded that the sale of haphazard has become an indispensable sale in our time, because of the need of the people, and this study also found that the sale of haphazard is an Islamic alternative to many corrupt contemporary financial sales, as well as this study found that the sale of the butchery can raise embarrassment and hardship and transport the followers to the circle of capacity when applied properly.
