الرقــــــابة الإداريــــــة على المـــــــال العــــــام بين الشريعة الإسلامية والقانون

Abstract

إن المال العام هو المحرك الأساسي والفَعَّال لعجلة الحياة، ولاقتصاد الدول والشعوب، فبالحكمة في استغلاله بشكل أحسن تتطور الحياة نحو الأفضل، وإن أسَاءت الشعوبُ وحكومَاتُها استغلاله، تقهقرت وحصدت معها الخيبة والفشل، وسوء المعيشة، لذلك ضبطت الشرائع السماوية - الشريعة الإسلامية تحديدًا- موضوع المال العام وأحكامه، حتى تضمن بلوغ الحقوق لأصحابها، وتوصَّل الفكر البشري إلى إيجاد ميكانيزمات تحفظ المال العام، وتُبْعدُ عنه عوامل العبث به وكلما يؤدي به على الضياع والتلف. فقد تناولت الدراسة البحثية هذه زويا متعددة، وجوانب مختلفة متعلقة كلها بالمال العام وجودًا وعدمًا، فتَقَصَّيْت فيها تحديد مفهوم المال العام بشكل مفصَّلٍ حتى أحصر نقاط الدراسة، وأحيط بالموضوع دِرايةً، ثم عَرَّجْتُ على دراسة الآلية التي تُمَكِّنُ المال العام من القيام بدوره كوسيلة فَعَّالةٍ لتنمية المجتمعات البشرية، والرفع من مقوِّماته الإنسانية، لتجسيد حضارة راقية بكُلِّ ما تحمله الكلمة من معانٍ، تجسِّد الخلافة الحقيقية للإنسان على الأرض، والتي فُضِّلَ بها عن سائر الخلق.

public expenditure is the essential and the efficient wheel or engine that makes life continues and the economy wheel of peoples and nations turn forward. Exploiting it wisely helps in leading to a better life. In case nations misuse it they will withdraw and decline. It also leads to complete failure and harsh living, that‘s why the different divine laws and precisely the Islamic law fixed the subject of public money and its rules so that to ensure that every part gets his due share of this public money. Thus the human brain arrived to find mechanisms that protect the public wealth and save it from loss and being damaged. -This research study tackled various angles and different aspects that are closely linked to the public money, both in presence or absence of this money. I started by defining the notion of the public money in details to highlight the points of the study and treat them thoroughly and to cover the subject topic as a whole. Then I moved to the study of the mechanism that allows the public money to play its role as an efficient means to contribute in building growing development for mankind nations and fostering its human values. The aim from this is to build a high quality civilisation in its proper meaning and incorporate the real succession on earth and the fact of being selected by Allah Our Creator among all other creatures.
