أحكام الرجوع في الهبة

Abstract

تناولت هذه الدراسة أحكام الرجوع في الهبة( دراسة مقارنة) جاءت بها مبحث تمهيدي وثلاثة مباحث وضمن كل مبحث ثلاثة مطالب، إضافة إلى مقدمة وخاتمة، هادفة إلى يبان وتوضيح حقيقة الرجوع في الهبة،وذلك من خلال بيان الأحكام الجزئية والتفصيلة لهذا الموضوع مبحث تمهيدي:بينت فيه حقيقة الرجوع والهبة، وما يقصد به لغة واصطلاحا المبحث الأول: وضحنا فيه مشروعية الهبة، وعرضنا شروط وأركان الهبة الخاصة بكل مذهب من المذاهب الأربعة. المبحث الثاني:حكم الرجوع في الهبة، بين ووضحنا فيه جواز الرجوع في الهبة إلا ما يهبه الوالد لوالده المبحث الثالث: موانع الرجوع في الهبة في القه الإسلامي، وذلك من خلال بيان الموانع المتعلقة بكل مذهب على حدا.

This study dealt with the provisions of the return in the gift (a comparative study( I came up with an introductory topic and three sections, and within each topic, there are three demands, in addition to an introduction and a conclusion, aiming to clarify and clarify the reality of the return in the gift, by explaining the partial and detailed provisions of this topic. An introductory topic: I explained in it the reality of return and gift, and what is meant by language and terminology The first topic: We explained the legality of the gift, and presented the conditions and pillars of the gift specific to each of the four schools of thought. The second topic: the ruling on recourse to the gift, and we explained in it the permissibility of recourse to the gift except for what the father gives to his father. The third topic: the impediments to recourse to the gift in the Islamic world, by explaining the impediments related to each sect separately. Conclusion: We summarized it in detail for the results of the study.
