علاقة الاستحسان بالمقاصد الشرعية وتطبيقاتها في الاجتهاد الفقهي المعاصر

Abstract

هذه دراسة أصولية مقاصدية تطبيقية لموضوع "علاقة الاستحسان بالمقاصد الشرعية وتطبيقاتها في الاجتهاد الفقهي المعاصر" تتناول بالتحليل والمناقشة إمكانية التجديد في دليل الاستحسان؛ هذا الدليل الذي طال أمد الخلاف فيه بين علماء الأصول، حتى صار من المسائل الخلافية في المباحث الأصولية. كل عنصر من عناصره محفوف بأنظار متباينة؛ ففي معناه أقوال، وفي تقاسيمه تضطرب الأنواع، وفي الاستدلال به يتنازع الأئمة بين الإعمال والإبطال، فهذه الدراسة تناولت دليل الاستحسان بنظرة تجديدية؛ من خلال بيان صلته بمقاصد الشريعة الإسلامية. وذلك باعتبارات عدة: من حيث ظهوره، ومن حيث مفهومه، ومن حيث مضمونه؛ حيث توصلنا أن الاستحسان متعلق بمقاصد الشريعة الإسلامية في كل عنصر من عناصره، وأن حجيته تكمن في كونه محقق لها ومحصل لها؛ فهو يأخذ بفقه الأولويات، ويراعي مبدأ رفع الحرج عن الخلق والتيسير بهم، ويضع في الاعتبار ما تمس الحاجة إليه، وينظر في الضرورة الملجئة، والحاجة التي تنزل منزلة الضرورة، فهو من خلال كل ذلك وثيق الصلة بعلم مقاصد الشريعة الإسلامية. كما بينا أن الاستحسان أصبح دليلا مستقلا كغيره من الأدلة الشرعية، وذلك باعتباره راجع إلى مقاصد الشريعة الإسلامية، كما له أهمية في تنشيط حركة الاجتهاد الفقهي المعاصر، وأنه أضحى دليل وأصل شرعي لا غنى عنه في معالجة قضايا عصرنا الحاضر، حيث ذكرنا جل تطبيقاته الفقهية المعاصرة وبينا صلتها بمقاصد التشريع؛ وتوصلنا إلى أن مستنده فيها المصلحة ومقاصد الشارع.

This is an applied, a principle, and a legislative purposeful study about “The Relationship of Istihsan with Shariah Objectives and its Applications in Contemporary Jurisprudential Independent Reasoning". The study examines and discusses the possibility of renewing al-Istihsan (Commendation); moreover, it explores how this evidence still has a dispute for a long time among the scholars of the principles of Islamic jurisprudence until it has become one of the questions controversy in the principles of Islamic jurisprudence.

All of its elements could be explained from different perspectives, so it has different meanings and there is no agreement on its classification; moreover, there is a dispute between authentic scholars about using it as evidence. Thus, the current study seeks to examine the evidence of Istihsan (Commendation) from a renewal aspect and exposes its relationship with legislative purposes of Islamic law. This is due to several considerations: in terms of its foundation, concept, and content; where the researcher concluded that commendation is related to the purposes of Islamic law in each of its elements. Furthermore, the core of its authenticity relies on achieving the purposes of the Islamic. It also takes into consideration the principle of removing embarrassment from creation and facilitating them, what is urgently needed, the urgent necessity, and the need that descends into the status of necessity. So, it has a deep relation with Islamic law . We have also shown that Istihsan (Commendation) has become independent evidence as other legal evidence. It has a vital role to support contemporary jurisprudential independent reasoning studies. It has become an indispensable legislative source in dealing with the issues of our present time. Moreover, we mentioned most of its contemporary jurisprudential applications and explained its relation with the purposes of legislation. And we also concluded that Istihsan is based on the public interests and Shariah objectives.
