الامتناع الإجرامي وأثره في الصّحة والطّفولة

Abstract

تنقسم الجرائم في الفقه الجنائي الإسلامي إلى عدة أنواع تبعا لاعتبارات ومعايير مختلفة ومن هذه التّقسيمات تلك المبنية على أساس صورة الفعل، أي مظهر السّلوك الإجرامي، حيث تنقسم بهذا الاعتبار إلى جرائم إيجابية وأخرى سلبية، وخذه الأخيرة هي موضوع البحث، واخترت تسميتها بالامتناع الإجرامي. وهذه الرّسالة تبحث في الأدلة الشّرعية لتجريم الامتناع، انطلاقا من النّصوص والكليات الشرعية، وتهدف إلى تأكيد أنّ هذا النّوع من الجرائم لا يقلّ خطرا عن الجرائم الإيجابية، لما تشكّله من أضرار على مختلف المصالح الدّينية والدّنيوية. وموقف الشّريعة الإسلامية من هذه الجريمة غاية في الوضوح إذ ألحّت الطّلب على الالتزام بالواجبات وشدّدت الوعيد على مخالفيها، خاصّة ما تعلّق منها بحقوق الآخرين والي على رأسها الحق في الحياة والحق في السّلامة. وقد جاءت الدّراسة التّطبيقية في مجالي الصّحة والطّفولة كسند ودليل واقعي على خطورة هذا النّوع من الجرائم النّاتج عن التّهاون في الالتزامات سواء الشّرعية منها أو التّعاقدية.

Criminal Unwillingness and its on Impact on Health and Childhood (An Applied study from the Islamic Legislation view point) Crimes in the islamic penal law are into several kinds ; depending on different criteria and considerations ; Among these kinds are the ones based on the way of the criminal action takes place.This kind is divided into positive and negative crimes.The latter is the subject of our research. And chose to name it the criminal unwillingness. This dissertation investigates the Islamic evidence of criminalizing unwillingness ; depending Islamic texts. We aim at emphasizing the fact that this kind of crime is no less dangerous than the positive crimes due to dangers it cause at both the religious life and every day matters. The islamic viewpoint about this question is quite clear because it insisted on fulfilling duties and warned those do not fulfill their duties especially those concerned with the rights of others the most important of which are the right of life and that of safety. This applied study in both health and childhood is considered as real evidence for the danger of this kind of crimes that result from neglecting duties.
