Abstract

الاهتمام بأحاديث الأحكام جمعا وترتيبا وتبويبا مما درج عليه علماء الأمة سلفا وخلفا, لأهميته في استنباط الأحكام, والتدليل عليها, ومن أهم ما ألف في المذهب المالكي في هذا المجال ما جمعه الإمام المقري في كتابه عمل من طب لمن حب, لما تميزت به من حسن ترتيب وتبويب, ومن اقتصار على الصحيح والحسن من السنة, والاقتصار في نص الحديث على محل الاستشهاد, ولعل أجل خدمة حظيت بها هذه الأحاديث شرح الشيخ محمد باي بن عمر الكنتي لها في موسوعته السنن المبين, ويأتي هذا البحث تعريفاً بالعالمين الجليلين, وبيانا لمنهج الشارح في شرحه للجزء محل الدراسة – أبواب الزكاة والصوم والحج-, وخدمة للنص بتخريج أحاديثه وتوثيق نصوصه, وتجلية مسائله, وضبط فهارسه بما يعكس قيمة الكتاب العلمية, ويجلي المصادر والمراجع التي اعتمد عليها في شرحه, وييسر الاستفادة منه, ويوقف القارئ والباحث على كثير من الفتاوى والنوازل التي تضمنها, والتحقيقات العلمية التي انفرد بها, كما ختمته بفهارس تيسر الاستفادة منه, والانتفاع به. والله الموفق.

Because of the importance of deducing the principles (provisions) and proving them, this doctorate dissertation is concerned with the collection, arrangement, and classification of the Hadiths of principles as being accustomed (adopted) by the nation’s scholars both successors and ancestors. What has been collected by El-Imam El-Mokri in his book “Aamal Man Tabba Liman Habba” is considered one of the most important written work in the Maliki Doctrine. The hadiths of this work are well arranged and classified, precisely confined to what is good and true in Sunnah, and mainly limited to quotation. Those hadiths have gained a great deal of interest in Cheikh Mohamed Bay Ben Omar El-Kounti’s elucidation in his encyclopedia:”Essunan El-Mubeen”. This dissertation, too, is to acquaint us with the two glorious scholars (already mentioned), to demonstrate Esharih’s method in explaining the part beingstudied: Chapters of Almsgiving, Fasting, and Pilgrimage, and to serve the provision by exposing the hadiths, documenting the principles, and checking up indexing (bibliographies). Thus, the book has gained an empirical value since the resources and references have been well adopted. As a result, this work in which we enhance useful indexing, is easily accessible and beneficial to readers and researchers who seek legal opinions (fatawa).
