النظام القانوني للضرر الجيني في القانون الجزائري والقانون المقارن

Abstract

المرغوبة؛ التي تجلت في أضرار تهدد الإنسان والنبات والحيوان والتنوع البيولوجي. ونتيجة لتراكم هذه الآثار برز مفهوم الضرر الجيني بشكل أكثر وضوح بفعل التهديدات الجسيمة التي تطال البشرية والبيئة على السواء. لذلك أصبح لزاماً على مختلف التشريعات الداخلية والدولية التصدي لهذا الضرر المستجد، وفق نظم فعالة تساهم في الإستفادة من التطور العلمي، وفي المقابل تجنب وكبح الضرر الجيني. تهدف هذه الدراسة إلى بيان التنظيم القانوني الفعال لمواجهة الضرر الجيني، من خلال البحث في مختلف التوجهات القانونية، وتوضيح مختلف الإشكالات والتداخلات القانونية التي تواجه المضرور، حتى يحظى بالحماية القانونية الكافية والفعالة لتجنب الضرر الجيني. الكلمات المفتاحية:

It is the result of modern scientific development and its applications in the field of genetic engineering are a set of undesirable effects; that are manifested in harms that threaten humans, plants, animals and biodiversity. As a result of the accumulation of these effects, the concept of genetic damage has emerged more clearly due to the grave threats that affect both humanity and the environment. Therefore, it has become imperative for various domestic and international legislation to address this emerging harm, according to effective systems that contribute to benefiting from scientific development and in return avoiding and curbing genetic damage. This study aims to clarify the effective legal regulation to confront genetic damage, by researching various legal trends, and clarifying the various problems and legal interventions facing the affected in order to have sufficient and effective legal protection to avoid genetic damage. key words:
