المجلس الدستوري الجزائري ودوره في تكریس دولة القانون

Abstract

من خلال دراسة هیئة المجلس الدستوري یتضح لنا، أن المؤسس الدستوري الجزائري كان یسعى من أجل تمكین هذه الهیئة من ممارسة دورها الرقابي بشكل فعال من خلال الإصلاحات الكثیرة التي أدخلها على مختلف الجوانب المتعلقة بها، تجسیدا لدولة القانون، ولقد بلغت تلك الإصلاحات ذروتها بموجب تعدیل 2016 .وفي الإطار ذاته فإن المجلس الدستوري ومن خلال اجتهاداته المتعددة حاول تجسید هذا الدور، من خلال إلزام السلطات الدستوریة الأخرى باحترام الأحكام الدستوریة، سواء تلك المتعلقة بتحدید صلاحیات كل منها، أو على مستوى تكریس الحقوق والحریات الدستوریة من خلال التصدي لمختلف النصوص القانونیة التي رأى بأنها تمس بتلك الحقوق. لكن بالرغم من ذلك فهناك العدید من المعوقات التي كانت تحول دون تمكین المجلس من القیام بدوره بشكل فعال، على غرار طبیعة تشكیلته، وكذا سیطرة السلطة التنفیذیة ممثلة في ر ئیس الجمهوریة علیها، أو بسبب آلیة الإخطار والتي تعتبر مصدر عرقلة لعمل هذا الأخیر خاصة قبل التعدیل الدستوري لسنة 2016 .ونتیجة لتلك الأسباب وغیرها كان دور المجلس الدستوري الجزائري محتشما لا سیما فیما یتعلق بحمایة وتعزیز الحقوق والحریات.

En étudiant le Conseil constitutionnel, il nous apparaît clairement que le fondateur de la Constitution algérienne s'efforçait de permettre à cet organe d'exercer efficacement son rôle de contrôle à travers les nombreuses réformes qu'il a introduites dans divers aspects qui lui sont liés, incarnant l'État de droit, et ces réformes ont atteint leur paroxysme sous l'amendement de 2016 Dans le même contexte, le Conseil constitutionnel, à travers ses différentes jurisprudences, a tenté d'incarner ce rôle, en obligeant les autres autorités constitutionnelles à respecter les dispositions constitutionnelles, qu'il s'agisse de celles relatives à la détermination des pouvoirs de chacune d'elles, ou au niveau de la consolidation des droits et libertés constitutionnels en s'attaquant aux différents textes juridiques qu'il considère comme portant atteinte à ces droits. Mais malgré cela, de nombreux obstacles ont empêché le parlement de pouvoir remplir efficacement son rôle, comme la nature de sa formation, ainsi la domination président de la République sur lui, ou en raison du mécanisme de la saisine, qui est considéré comme une source d'obstruction au travail de ce dernier, en particulier avant l'amendement constitutionnel pour l'année 2016. En ces raisons et d'autres, le rôle du Conseil constitutionnel algérien a été modeste, en particulier en matière de protection et de promotion des droits et libertés.

By studying the Constitutional Council, it seems clear to us that the founder of the Algerian Constitution endeavored to allow this body to exercise its role of control effectively through the numerous reforms that he introduced in various aspects related to it. , embodying the rule of law, and these reforms reached their climax under the 2016 amendment. to respect the constitutional provisions, whether those relating to the determination of the powers of each of them, or at the level of the consolidation of constitutional rights and freedoms by attacking the various legal texts which he considers to be infringing on these rights. But despite this, many obstacles have prevented the parliament from being able to fulfill its role effectively, such as the nature of its formation, thus the domination of the President of the Republic over it, or because of the referral mechanism, which is considered to be a source obstruction of the work of the latter, in particular before the constitutional amendment for the year 2016. For these and other reasons, the role of the Algerian Constitutional Council has been modest, particularly in terms of protecting and promoting the rights and freedoms.
