حدود السلطة التنظيمية لرئيس الجمهورية

Abstract

لقد أصبح رئيس الجمهورية يشرع في المجالات الغير مخصصة للقانون ، وذلك بواسطة السلطة التنظيمية المستقلة الممنوحة له بموجب المادة 141 من التعديل الدستوري لسنة 2020 فيمارس صلاحياته التنظيمية في مجال واسع غير محدد باستثناء المجالات المخصصة للقانون ، فلا يمكنه التعدي عليها ، مما يفيد أن مجال السلطة التنظيمية المستقلة الواسع يعتبر بمثابة آلية داعمة لمركز رئيس الجمهورية في مواجهة البرلمان في مجال صنع القانون بمفهومه الواسع ، وإن كان للسلطة التنظيمية مجال خاص إلا أنها مقيدة بالرقابة الدستورية بواسطة المحكمة الدستورية المستحدثة بموجب التعديل الدستوري لسنة 2020 ، و الرقابة القضائية بواسطة مجلس الدولة أي قضاء الإلغاء.

The President of the Republic has begun to legislate in areas not designated for law, by means of the independent regulatory authority granted to him under Article 141 of the constitutional amendment for the year 2020, exercising his regulatory powers in a broad, unspecified field with the exception of areas designated for law, which he cannot infringe upon, which indicates that the field of independent regulatory authority The broad is considered as a supportive mechanism for the position of the President of the Republic vis-à-vis Parliament in the field of law-making in its broadest sense, although the regulatory authority has a special field, but it is restricted by constitutional oversight by the Constitutional Court created under the constitutional amendment of 2020, and judicial oversight by the State Council, i.e. the abolition judiciary.
