الجزاء الإداري وضماناته

Abstract

ان الهدف من هاته الدراسة التي بين أيدينا التعرف على الجزاء الإداري وضماناته التي يكفلها القانون الجزائري لاكتساب المشروعية القانونية وذألك من خلال الرقابة الإدارية التي يخضع لها وحدود سلطات القاضي الإداري في اصدار القرارات ومدى احترام المبادئ الشكلية والإجرائية من تسبيب للقرارات وعدم التعددية ومناسبة القرار للجزاء وملائمته لأنه لا يوجد جزاء الا بنص قانوني مع احترام ومراعاة حق الدفاع والطعن في هاته القرارات من طرف العامل نفسه او الجهات الوصية عليه فكان لابدا من توفر جميع هاته الشروط ليحظى هذا الجزاء بالمشروعية القضائية التي يضمنها النصوص القانونية .

The aim of this study that we have before us is to identify the administrative penalty and its guarantees that are guaranteed by Algerian law to acquire legal legitimacy through the administrative control to which it is subject and the limits of the administrative judge’s powers in issuing decisions and the extent of respect for the formal and procedural principles of causation of decisions and lack of pluralism and the appropriateness of the decision to the penalty and its suitability because There is no penalty except by a legal text with respect and observance of the right of defense and appeal against these decisions by the worker himself or his guardians, so all these conditions had to be met in order for this penalty to enjoy the judicial legitimacy guaranteed by the legal texts.
