التستر على الجاني دراسة مقارنة بين القانون والشريعة الاسلامية

Abstract

تهدف دراسة هذا البحث إلى إعطاء صورة واضحة لمفهوم التستر على الجاني بين القانون الجزائري والشريعة الإسلامية بما فيه تعريف لمصطلحات البحث وذكر أنواعه إضافة إلى بيان أسبابه وأركانه وإبراز العقوبة المقررة له في القانون الجزائري والشريعة الإسلامية لما فيها ضرر وخطورة على الفرد خاصة وعلى المجتمع عامة وذلك بالاعتماد على المنهج المقارن والمنهج الوصفي التحليلي وكل هذا كان على حساب الجانب النظري دون التطبيقي. وبعد استقصاء وتتبع مصادر الدراسة ثم التوصل إلى أن للتستر على الجاني عوامل واسباب داخلية وخارجية تدفع الشخص إلى القيام بهذا الفعل المعاقب عليه قانونيا وشرعيا.

The purpose of this study is to give a clear picture of the concept of covering up the perpetrator between Algerian law and Islamic law, including a definition of the terms and types of research, as well as to indicate its causes and elements, and to highlight the penalty prescribed for it in Algerian law and Islamic sharia law for harm and gravity to the individual, especially society at large, by drawing on the comparative approach and analytical descriptive approach. After investigating and tracking the sources of the study, it was then concluded that to cover up the perpetrator, internal and external factors and reasons prompted the person to carry out this legally and legally punishable act.
