استثمار الأراضي الوقفية الفلاحية بالمزارعة والمساقاة في الفقه الإسلامي والقانون الجزائري

Abstract

يعتبر الوقف أحد ميزات الحضارة الإسلامية, وهو يعتبر أيضاً من الصدقات والتبرعات التي لها أجر عظيم عند الله سبحانه وتعالى, إذ لا ينقطع ثوابها إلى يوم القيامة, ومؤسسة الوقف من المؤسسات التي لعبت دورا فعالا في تاريخ الحضارة الإسلامية. ولقد حث الفقهاء على استثمار الأراضي الوقفية الفلاحية, بالعديد من الطرق, أهمها: المزارعة والمساقاة. واهتم المشرع الجزائري على غرار باقي التشريعات الأخرى, كالمغربي, والمصري..الخ بسن قوانين تنظم الأملاك الوقفية وكيفية تسييرها وإدارتها, وتوضيح طرق استثمارها, من بينها المزارعة والمساقاة, حسب ما جاء في القانون رقم 91_10 المتعلق بالأوقاف. ويتناول هذا البحث بدراسة هذه الطرق المذكورة, لما لها من أهمية في المجتمع.

The endowment is one of the features of Islamic civilization, and it is also considered one of the alms and donations that have a great reward with God Almighty, as its reward will not be interrupted until the Day of Resurrection, and the endowment institution is one of the institutions that played an active role in the history of Islamic civilization. The jurists urged the investment of agricultural endowment lands, in many ways, the most important of which are: sharecropping and watering. The Algerian legislator, like other legislations, such as Moroccan, Egyptian, etc., was concerned with enacting laws regulating endowment properties, how they are managed and managed, and clarifying the ways of investing them, including sharecropping and watering, according to Law No. 91_10 related to endowments. This research deals with the study of these methods mentioned, because of their importance in society.
