سيادة الأمة في الرقابة على شرعية أعمال السلطة وآلياتها السياسية

Abstract

تعد فكرة السيادة في الأنظمة القانونية المسيرة للشؤون الداخلية وكذا علاقات الدول عنصر أساسي ورئيسي في استمرار أمن الدولة كما انها تعد من اهم النظريات الهامة في مجال القانون الدستوري نظرا لتأثير ها على شرعية السلطة وحدودها وقد أخدت دساتير الدولة الحديثة بهذه النظرية ومن بينها الدساتير الجزائرية ولذلك حاولنا من خلال هده الدراسة معالجة موضوع من اهم المواضيع الحساسة في الدولة حيث عالج هذا الموضوع سيادة الأمة ،مبينا فيه مدي اختلاف هذا المفهوم في الفقه الإسلامي عن القوانين الدولية والدستورية إضافة إلى مدي تأثير الدساتير الجزائرية لتكريس هذا المبدأ. وللوصول إلى هدا الهدف ثم تقسيم هدا البحث إلى فصلين الفصل الأول تطرقنا فيه إلى ماهية سيادة الأمة في الرقابة على أعمال السلطة فقها وقانونا من حيث مفهومها واساسها التشريعي الفلسفي أما الفصل الثاني تطرقنا فيه إلى مظاهر سيادة الأمة في الرقابة وأليتها الدستورية.

It is one of the most important theories in the field of constitutional law because of its impact on the legitimacy of power and its borders. The constitutions of the modern State have taken up this theory, including Algerian constitutions. s Constitution ", stating the extent to which this concept differs in Islamic jurisprudence from international and constitutional laws, as well as the effect of Algerian constitutions to enshrine this principle. In order to achieve this goal, and then divide these research into two chapters, chapter I, in which we address what is the nation's sovereignty over the acts of power in its jurisprudence and law in terms of its philosophical concept and legislative basis.
