المسائل المتعلقة بالضمان و النفقة من فروق القرافي ترتيب البقوري

Abstract

ينحصر موضوع البحث في دراسة الجزئيات المتعلقة بالفرقين الضمان و النفقة من كتاب الفروق للإمام قرافي حسب تعليقات تلميذه الإمام البقوري في كتابه ترتيب الفروق، وكان من الاهمية أيضا ما جاء به أبن الشاط من تعليقات. تهدف هذه الدراسة الى توضيح أوجه الفروق وما بني عليها فيما تعلق بالمسائل المتعلقة بالضمان و النفقة من فروق القرافي حسب ترتيب البقوري. البحث كان عبارة عن دراسة تأصيلية، حيث جمع منهجين أساسين، المنهج التحليلي، و المنهج المقارن. أهم النتائج البحث تمثلت في الفروق المستنبطة من جزئيات القواعد المتعلقة بالضمان و المتعلقة بالنفقة، وكذلك بعض المسائل التي أضافها البقوري لمسائل الضمان كان لها اهمية كبيرة . ومن التوصيات العناية بباقي مسائل القواعد التي جاء بها الإمام القرافي، التي لم يتطرق اليها الدارسون في علم الفروق.

The subject of the research is limited to the study of the details related to the difference between insurance and alimony from the book of differences by Imam qarafi, according to the comments of his disciple Imam Al-Baquri in his book The Order of differences, and it was also important what Ibn al-shat said from the comments. This study aims to clarify the differences and the differences based on them in relation to issues related to security and alimony from the differences of qarafi according to the order of the cows. The research was a thorough study, combining two basic approaches, the analytical approach, and the comparative approach. The most important results of the research were the differences deduced from the parts of the rules related to security and related to alimony, as well as some issues that bakouri added to the security issues were of great importance . One of the recommendations is to take care of the rest of the issues of the rules that Imam Al-qarafi came up with, which the scholars in the science of differences did not address.
