القياس الأصولي والقياس اللغوي (دراسة مقارنة )

Abstract

المباحث اللغوية بين علماء الأصول وعلماء اللغة والبلاغة فإن هذه الدراسة أشارت إلى تعرض الأصوليين للمباحث اللغوية والبلاغية , وتطور ت هذه العلاقة منذ المراحل المبكرة لعلم أصول الفقه, كما أوضحت أن فهم معاني الخطاب الشرعي مبنية في الأصل على فهم مكونات الخطاب اللغوية والسياقية والدلالية , كما حولت هذه لدراسة أن تلقي الضوء على التفاعل الاستمدادي الأصولي اللغوي , والذي كان واضحا في المباحث اللغوية الأصولية , كما بينت هذه الدراسة أن متقدمي الأصوليين لم يتوسعوا في التقسيمات والتعاريف المتخصصة على عكس ما وجدوه عند متأخري الأصوليين , حيث أنهم توسعوا توسعا كبيرا في هذه المباحث, كتوسعهم في علم الدلالات اللسانية ومباحث السياق, الذي أصبح أحد مناهج البحث المتصلة بعملية استنباط الأحكام. واشتملت هذه الدراسة على ثلاثة فصول : الفصل الأول تناول أهم الموضوعات والمباحث اللغوية والبلاغية التي ذكرها الأصوليون في مقدماتهم ومسائلهم اللغوية, وأما الفصل الثاني فكان في المباحث اللغوية بين علماء الأصول وعلماء اللغة والبلاغة, وجاء الفصل الثالث متناولا أهم المؤلفات المطبوعة, والتي اهتمت بالصلة والعلاقة بين علماء الأصول واللغة العربية.

Linguistic investigations between scholars of origins and scholars of philology and rhetoric, this study indicated the exposure of fundamentalists to linguistic and rhetorical investigations, and this relationship developed since the early stages of the science of jurisprudence, as it clarified that understanding the meanings of legal discourse is based on understanding the linguistic, contextual and semantic components of discourse, as it transformed This is a study that sheds light on the linguistic fundamentalist interaction, which was evident in the fundamental linguistic investigations, and this study also showed that the advanced fundamentalists did not expand in specialized divisions and definitions, in contrast to what they found with the later fundamentalists, as they expanded greatly in these investigations, such as their expansion In linguistic semantics and context investigations, which became one of the research methods related to the process of deriving judgments. This study included three chapters: the first chapter dealt with the most important linguistic and rhetorical topics and topics mentioned by the fundamentalists in their introductions and linguistic issues, and the second chapter was in linguistic investigations between scholars of origins, philologists and rhetoricians, and the third chapter dealt with the most important printed literature, which focused on the connection and relationship between Scholars of origins and Arabic language.
