التعويض عن الخطأ القضائي دراسة مقارنة بين الشريعة الإسلامية والقانون الجزائري

Abstract

يقتصر موضوع هذه المذكرة حول التعويض عن الخطأ القضائي في الشريعة الإسلامية وفي القانون الجزائري حيث يترتب هذا التعويض في حالة ارتكاب القاضي لخطأ شخصي مرتبط بالمهنة، وفي حالة إصدار حكم جنائي بالإدانة كالحكم على شخص بالبراءة وهو ظالم، وفي حالة الحبس المؤقت غير المبرر كالحكم بحبس شخص وهو بريء، كما يجب التعويض عن الأخطاء التي يرتكبها ضباط الشرطة القضائية أثناء أدائهم لعملهم.

The subject of this memorandum is limited to compensation for judicial error in Islamic Sharia and Algerian law, where this compensation is required in the case of a judge committing a personal error related to the profession, and in the case of issuing a criminal judgment of conviction, such as acquitting a person who is unjust, and in the case of unjustified temporary detention, such as the imprisonment of a person He is innocent, and compensation must be paid for the errors committed by judicial police officers in the course of their work.
