التعارض بين المصلحة المرسلة والنص عند سعيد رمضان البوطي

Abstract

راعى الشريعة الإسلامية مصالح العباد، وجعلتها مقصد من مقاصدها، إلا أنها تركت مصالح دون نص بالاعتبار أو الإلغاء وهي المصالح المرسلة، حيث تتعارض هذه الأخيرة مع النص، وتختلف مواقف العلماء حيال ذلك. وانتهجنا في هذا البحث خطة توضح الموضوع بمضمونه قوامها أربعة مباحث. يخص المبحث الأول ترجمة للشيخ البوطي، والمبحث الثاني يضم التعريف بمصطلحات العنوان، أما المببحث الثالث يحتوي على مذاهب العلماء في التعارض بينهما، والمبحث الرابع والأخير يخص موقف الشيخ البوطي من التعارض بين المصلحة المرسلة والنص وهو عنوان البحث. واستنتجنا من خلال دراسته أن الشيخ البوطي يرى أنه لا وجود لمصلحة إذا عارضت النص.

Islamic Sharia took into account the interests of the people, and made it one of its purposes, but it left interests without a text into consideration or cancellation, and they are the interests sent, as the latter contradicts the text, and the positions of scholars differ in this regard. In this research, we adopted a plan that clarifies the subject in its content, consisting of four sections. The first topic concerns a translation of Sheikh al-Bouti, the second topic includes the definition of the terms of the title, the third topic contains the doctrines of scholars in the conflict between them, and the fourth and final topic concerns Sheikh al-Bouti’s position on the conflict between the sent interest and the text, which is the title of the research. We concluded through his study that Sheikh Al-Bouti sees that there is no interest if it is opposed to the text
