Abstract

يحيل هذا البحث الى القارئ الى الاطلاع على مختلف التخريجات الفقهية واللغوية لمباحث الامر والنهي ،باعتبارهما ركنا الخطاب الشرعي وأساس التكليف في توجيه الخطاب الى المكلفين ، ومعرفة الاحكام الشرعية متوقفة عليهما ومنوطة بهما . ونهدف هذه الدراسة الى الكشف عن طبيعة الخلاف الاصولي اللغوي في مدلولات الامر والنهي وبيان نوعيته اللفظية أو المعنوية ، ومن ثم يمكن أن ينتج عن ذلك الخلاف من أثر فقهي في الاحكام الشرعية ويفتح هذا البحث باب من أبواب علمية جديدة من الدرس الاصولي واللغوي على حد سواء نحو مزيد من التخريجات الفقهية على القواعد الأصولية اللغوية

This research refers the reader to reviewing the various jurisprudential and linguistic conclusions of the command and prohibition investigations, as they are the pillars of the legal discourse and the basis of the assignment in directing the discourse to the taxpayers, and knowledge of the legal rulings depends on them and is entrusted to them.
