المسؤولية الجنائية الناشئة عن عمليات نقل الدم الملوث في التشريع الجزائري

Abstract

تعتبر عملية نقل الدم وسيلة علاجية لإنقاذ حياة المرضى والمصابين في الحوادث المختلفة، لذلك فإن عدم خضوعها لإجراءات وفحوصات طبية دقيقة للتأكد من خلوه الفيروسات، تصبح وسيلة إجرامية لجلب الضرر والموت، حيث استغلها الجناة لتحقيق غاياتهم الإجرامية دون أن يقعوا تحت طائلة العقاب. إن غياب النص الخاص الذي يجرم عملية نقل دم ملوث للغير في التشريع الجزائري، دفع بنا لتسليط الضوء على بعض الجرائم العمدية والغير عمدية الموجودة في قانون العقوبات والتي يمكن أن تنطبق أوصافها على الصور المختلفة للإضرار بالدم، باعتبار أن غايتنا من ذلك كله معرفة مدى فعاليتها في إثارة المسؤولية الجزائية.

Therefore, it is not subject to accurate procesdures and medical examinations to ensure that it is free of viruses , it becomes a means of transmitting serious diseases, As well as a criminal means to bring harm and death, as the prepetrators exploited them to achieve their criminal without ends being punished. The absence of a specific provision criminalizing the deliberate transfer of contaminated blood to third parties in the algerian penal legislation has led us to hightlight some of the international and not international crimes currently in the penal code whose descriptions may apply to different forms of blood damage our aim is to find out how effective it is in excitement criminal responsability.
