المسؤولية التأديبية للمحامي في التشريع الجزائري

Abstract

تعرف المسؤولية التأديبية للمحامي بأنها كل إخلال بالنصوص القانونية أو التنظيمية أو قواعد المهنة أو أعرافها، أو كل الإخلال بالمروءة والشرف والنزاهة ولو تعلق الأمر بأعمال خارجة عن النطاق المهني فهي بذلك تمس كرامة وسمعة وسمو المهنة ورسالتها. كما أن المسؤولية المحامي التأديبية تقوم على أساس الخطأ الجسيم أو الخطأ البسيط ، وذلك من خلال مخالفته للنصوص القانونية التي تحدد واجباته والتزاماته، وبالتالي يسأل عن الأخطاء المهنية التي يرتكبها خلال ممارسة مهنته في الدفاع عن موكله، وعند إخلاله بذلك يصبح معرض لعقوبة تأديبية بموجب قرار صادر من طرف المجلس التأديبي والذي يقبل الطعن فيه أمام اللجنة الوطنية الطعن، ليتمكن المحامي من مصلحة الطعن كذلك في قرارات اللجنة الوطنية للطعن أمام مجلس الدولة.

A lawyer's disciplinary liability is defined as any violation of the legal, regulatory, professional rules or customs, or all infringement of the dignity, honor and integrity of the profession, even if the acts are outside the scope of the profession, and thereby infringe on the dignity, reputation, superiority and mission of the profession. The disciplinary liability of counsel is based on gross or simple error, by contravening the legal provisions that define his duties and obligations. He is thus asked about professional errors committed during the exercise of his profession in the defense of his client. When he fails to do so, he is liable to disciplinary punishment under a decision issued by the Disciplinary Board, which can be appealed before the National Committee for Appeal, so that the lawyer can also appeal the decisions of the National Committee to the Council of State.
