المسؤولية التأديبية للقضاة في التشريع الجزائري

Abstract

إستهدفت هذه المذكرة دراسة موضوع المسؤولية التأديبية للقضاة في التشريع الجزائري، حيث أن القاضي معرض لارتكاب أخطاء مهنية مؤثرة على مساره المهني، وبالتالي فهو معرض للمساءلة التأديبية أمام المجلس الأعلى للقضاء. و بالنظر الى خصوصية مرفق القضاء قام المشرع بوضع نظام خاص بالتأديب، موقعا على القاضي عقوبات تأديبية رادعة له، ففي حال ارتكاب القاضي خطأ مهنيا يمس بشرف المهنة يتخذ المجلس الأعلى للقضاء الإجراءات التأديبية اللازمة حسب ما نص عليه القانون الأساسي للقضاء، مع مراعاة الضمانات التي أقرها المشرع .

This memorandum aimed to study the issue of the disciplinary responsibility of judges in Algerian legislation, as the judge is prone to commit professional errors affecting his professional path, and therefore he is subject to disciplinary accountability before the Supreme Judicial Council. In view of the peculiarity of the judiciary facility, the legislator has established a special discipline system, imposing deterrent disciplinary penalties on the judge. In the event that the judge commits a professional mistake that affects the honor of the profession, the Supreme Judicial Council takes the necessary disciplinary measures as stipulated in the Basic Law of the Judiciary, taking into account the guarantees established by it.
