التزامات المنتج تجاه المستهلك في ضوء قانون حماية المستهلك الجزائري

Abstract

تهدف الدراسة إلي تنوير عقل المستهلك باعتباره الطرف الضعيف في العلاقة التعاقدية ونشر الوعي وسط المجتمع، وتنبيهيه بمدى ضرورة وأهميته علي مختلف الالتزامات التي تقع علي عاتق المنتج ومحاولة الكشف عن أهمية علم المستهلك بالمنتجات التي يقوم باقتنائها لاسيما المنتجات الخطيرة، ومدى التزام المنتج بضمان صلاحية منتوجه والضمانات المترتبة عليه عند الإخلال بالتزاماته، مما يساهم دالك في الحد من المخاطر التي يتعرض لها المستهلك من عدم صلاحية المنتوج. حرصا من المشرع وحفاظا علي سلامة لمستهلك فقد اصدر قانون 09/03 والمتعلق بحماية المستهلك وقمع الغش والدي بدوري يتكفل بحماية حقوق المستهلكين، كما رتب علي المتدخل المخالف لالتزاماته عقوبات إدارية وأخرى جزائية، وكدالك قام بضع هيئات رقابية من اجل المحافظة علي سلامة المستهلك.

The study aims to enlighten the mind of the consumer, as he is the weak party in the contractual relationship, spread awareness in the community, and alert him to the extent of the necessity and importance of the various obligations that fall on the producer and try to reveal the importance of consumer knowledge of the products that he buys, especially dangerous products, and the extent of the producer’s commitment to ensuring the validity of his product and guarantees. This will contribute to reducing the risks that the consumer is exposed to due to the invalidity of the product. In the interest of the legislator and in order to preserve the safety of the consumer, he issued Law 09/03 related to consumer protection and the suppression of fraud. My role is to protect the rights of consumers. It also arranged administrative and other punitive penalties for the intruder who violated his obligations, and likewise a number of control bodies were established in order to maintain consumer safety.
