التحقيق العقاري في التشريع الجزائري

Abstract

إن قانون 07-02 جاء نتيجة بطئ عملية مسح الأراضي وعدم تطابق الوضعية الفعلية للعقارات مع الوضعية القانونية لهذا قام المشرع الجزائري بسن القانون 07-02 المؤرخ في 27/02/2007 المتضمن تأسيس إجراء لمعاينة حق الملكية العقارية الخاصة وتسهيل إجراءات المسح .وقد بين المشرع من خلال المرسوم التنفيذي 08-147 المؤرخ في 19/05/2008 المتعلقة الملكية إجراءات اكتساب الملكية العقارية والذي على أساسه يتم تسليم سند الملكية لكل شخص تتوفر فيه شروط القانونية . حيث يكفل تمكين الغير ممن له مصلحة على العقار محل التحقيق العقاري تقديم الاعتراضات على النتائج التحقيق العقاري إداريا ، التي يتولى المحقق العقاري البث فيها عن طريق جلسة الصلح باستدعاء الأطراف ‘ غير انه في حالة فشل الحل وديا يتم اللجوء إلى القضاء ،وذلك قبل التسوية النهائية لوضعية العقار ضمن البطاقات العقارية في السجل العقاري .

Law 07-02 came as a result of the slow process of surveying the land and the mismatch of the actual situation of real estatewith the legal situation. This iswhy the Algerian legislatorenacted Law 07-02 of 27/02/2007, whichincluded the establishment of a procedure for examining the right of private real estate and facilitating the surveyprocedures. ThroughExecutiveDecree 08-147 dated 19/05/2008 related to ownership, the procedures for acquiring real estateownership, on the basis of which the titledeedisdelivered to eachpersonwhomeets the legalrequirements. As itensuresthatotherswho have an interest in the real estatesubject of the real estate investigation are to submit objections to the results of the real estate investigation administratively, which the real estateinvestigatorbroadcaststhrough a reconciliation session by summoning the parties. The propertyisincluded in the real estatecards in the Land Registry.

La loi 07-02 est née de la lenteur du cadastre et de l'inadéquation entre la situation réelle du foncier et la situation juridique, c'est pourquoi le législateur algérien a promulgué la loi 07-02 du 27/02/2007 qui comprenait la mise en place d'une procédure d'examen du droit immobilier privé et facilitant les procédures d'enquête Par le décret exécutif 08-147 du 19/05/2008 relatif à la propriété, les procédures d'acquisition de la propriété foncière, sur la base desquelles le titre de propriété est délivré à chaque personne qui remplit les conditions légales. Comme il veille à ce que d'autres personnes ayant un intérêt dans l'objet immobilier de l'enquête immobilière soumettent administrativement des objections aux résultats de l'enquête immobilière, que l'enquêteur immobilier diffuse par le biais d'une séance de réconciliation en convoquant les parties. est inclus dans les fiches foncières du Registre Foncier.
