تعزيز حق تمثيل المرأة في المجالس المنتخبة بين دعم الحق ومخالفة مبدأ المساواة

Abstract

باشرت الجزائر مجموعة من الإصلاحات السياسية بداية من سنة 2008، نتيجة لجملة من العوامل الداخلية والخارجية، والتي أسفرت عن تعديل دستوري جزئي، وتعديل لمجموعة من القوانين ذات العلاقة بحقوق المرأة، وكان من ثمرة التعديل الجزئي للدستور النص على ترقية تمثيل المرأة في المجالس المنتخبة، هذه الغاية التي تم تجسيدها بموجب القانون العضوي رقم 12-03 المحدد لكيفيات توسيع حظوظ تمثيل المرأة في المجالس المنتخبة، وعلى إثر ذلك تبنت الجزائر تطبيق نظام الحصة النسوية كآلية لتعزيز ذلك التمثيل، هذا التوجه الذي أثار جدلا كبيرا على جميع المستويات بين مؤيد ومعارض لتطبيق هذا النظام، وكان الجدل منصبّا على كون نظام الحصة النسوية مخالفا لبعض للمبادئ الدستورية وهي مبدأ المساواة والمبادئ ذات العلاقة به أم أنه داعم لهذا المبدأ؟.
