مسائل النكاح من فروق القرافي ترتيب البقوري

Abstract

بسم االله الرحمان الرحيم والصلاة والسلام على حبيبه المصطفى وبعد، فموضوع "مسائل النكاح والطلاق وما جانسهما من فروق القرافي ترتيب البقوري دراسة فقهية تأصلية من الفرق العاشر إلى الفرق السابع عشر . موضوعا شاسعا فمن خلال البحث والتطلع عن خبايا هذا الموضوع توصلت للإشكال المطروح ، ما منهج الإمام القرافي في دراسته لا للفروق بين المسائل الفقهية ؟ و ما مدى تحقيق عمل الإمام البقوري في الفروق ترتيبا واختصارا واستدراكا ؟ وقد اعتمد ت على منهجية واحد وهي أخذ نص المسألة من كتاب البقوري (الترتيب)، وبيان وجه الفرق في المسألة من كتاب (الفروق) ، والخلاصة . ومن خلال دراسة هذه الموضوع قمت بوضع خطة قوامها: مقدمة، وثلاثة مباحث . وفي الأخير خلصت لبعض النتائج من بينها: 1- أجاز الشارع الحكيم لرجل الجمع بين أربع حرائر لا زيادة فوق ذلك خلافا في الإماء فله أن يزيد عن الأربع. 2- يحرم الجمع بين كل امرأتين بينهما من النسب والرضاع ،فلا يجوز الجمع بينهما في الوطء بعقد ولا ملك .

In the name of God, the Most Gracious, the Most Merciful, and may peace and blessings be upon his beloved Mustafa Imam Al-Qarafi in his study No to the differences between jurisprudential issues?And what is the extent to which Imam Al-Baqouri’s work on the differences was achieved in order, summary and rectification? It relied on one methodology, which is to take the text of the issue from the book of Al-Baqouri (the arrangement), and to explain the difference in the issue from the book (the differences), and the summary. Through the study of this subject, I developed a plan consisting of: an introduction, and three sections. In the end, I concluded some results, including: 1- The wise legislator has permitted a man to combine four wives, with no more than that, as opposed to a female slave. 3- It is forbidden to combine lineage and breastfeeding between every two women, and it is not permissible to combine them in sexual intercourse with a contract or property.
