حجية الدفاتر التجارية في الإثبات أمام القضاء

Abstract

تدور هذا الدراسة حول " حجية الدفاتر التجارية في الاثبات وفقاً للقانون الجزائر"، وذلك بعدما أصبح للدفاتر التجارية الالكترونية ذات الحجة والقيمة القانونية المقررة للدفاتر التجارية التقليدية أمام المحاكم في الجزائر، وفقاً لقانون المعاملات الالكترونية رقم 15-04 حيث يهتم هذا البحث ببيان مدى حجية الدفاتر التجارية الالكترونية في الاثبات وشروط تطبيقها والتأكد من انتظامها كواحدة من طرق الاثبات المقررة للتاجر بكافة أنواعها، لا سيما وأن سجلات ومعاملات التجار أصبحت اليوم تتم في غالبها عبر استخدام تقنية المعلومات

This study revolves around "the authenticity of commercial books in proof according to the Algerian law", after the electronic commercial books with the argument and the legal value established for the traditional commercial books before the courts in Algeria, according to the Electronic Transactions Law No. 15 04, where this research is concerned with showing the extent of the authenticity of the books Electronic commerce in the proof and conditions of its application and ensuring its regularity as one of the established methods of proof for the merchant of all kinds, especially since the records and transactions of merchants are today mostly done through the use of information technology
