نظام التقادم المكسب في الشريعة الإسلامية والقانون الجزائري

Abstract

الملكية العقارية نظام قانوني وشرعي لما لها أهمية بالغة على المستوى الإقتصادي والإجتماعي كما أن أحكامها تبنى على العقار باعتباره عنصرا أساسي للملكية، كما أن حق الملكية من أهم الحقوق العينية الأصلية حيث تعددت طرق اكتسابها بتعدد الوقائع والتصرفات القانونية على رأسها الحيازة والتقادم، وعليه فالتقادم ماهو إلا وسيلة لإستقرار المراكز القانونية الصحيحة وذلك ما جعل كل التشريعات المدنية العالمية تعترف به وتنظمه إذا جعلت له أحكام وشروط ابرزها الفقهاء والقانونيين التي ذكرت في الجانب القانوني بصفة إجمالية إلا أن فقهاء الشريعة تحدثوا عنها مفصلة، كما نجد أن التقادم المكسب تترتب عليه آثار في الشريعة الإسلامية تتفق مع القانون في كسب ملكية العقار بالتقادم المكسب.
