الحماية القانونية لأموال القاصر

Abstract

تناول موضوع البحث الحماية القانونية لأموال القاصر، وقد عمل الفقه الإسلامي وقوانين الأسرة المغاربية جاهدة على توفير حماية متكاملة لأموال القاصر، وذلك في جملة من النصوص والآراء والاجتهادات، وقد ركز البحث على أسلوبين مهمين لهذه الحماية، ويتمثل ذلك في أسلوب إمساك مال القاصر وتسكينه وهو يعد كآلية وقائية لهذه الأموال، أما الأسلوب الثاني فيتمثل في أسلوب الاستثمار والتنمية لأموال القاصر، وكلا الأسلوبين أو الآليتين يكملان بعضهما البعض لتوفير حماية متكاملة لأموال القاصر.

The topic of the research dealt with the legal protection of the money of the minor, and Islamic jurisprudence and the laws of the Maghreb family worked hard to provide integrated protection for the money of the minor, in a number of texts, opinions and jurisprudence. As a preventive mechanism for these funds, the second method is represented in the method of investment and development for the funds of the minor, and both methods or mechanisms complement each other to provide integrated protection for the funds of the minor.

Le thème de la recherche portait sur la protection juridique de l'argent du mineur, et la jurisprudence islamique et les lois de la famille maghrébine ont travaillé dur pour assurer une protection intégrée de l'argent du mineur, dans un certain nombre de textes, d'avis et de jurisprudence. En tant que mécanisme de prévention de ces fonds, la deuxième méthode est représentée dans la méthode d'investissement et de développement des fonds du mineur, et les deux méthodes ou mécanismes se complètent pour assurer une protection intégrée des fonds du mineur.
