إستقالة القاضي في القانون الجزائري والفقه الإسلامي

Abstract

يعد القضاء طريقا لقيام الأمم ولسعادتها وعيشها حياة طبيعية، ولنصرة المظلوم ورفع الظلم وقطع الخصومات والأمر بالمعروف والنهي عن المنكر، وللضرب على أيد العابثين وأهل الفساد لكي يسود النظام فيأمن كل فرد فيه على نفسه. ومن ثم يزيد الإنتاج فتنهض البلدان لما يصلحهم في دينهم ودنياهم. ومن ثم لاحظنا أن للقضاء طرقا لانتهاء الولاية فيه والمتمثلة في العزل والانعزال والاستقالة، وهاته الأخيرة التي تمت دراستها استقالة القاضي في كل من النظامين: النظام القضائي الإسلامي والتشريع الجزائري، نخلص فيها بعون الله وتوفيقه إلى حقيقة مفادها: أن الاستقالة تعبير عن ابداء الرغبة في الخروج من النطاق العقدي أما في الفقه فهي أن يعزل القاضي نفسه، والمشرع الجزائري عالج موضوع الاستقالة من جهة اعتبارها حالة من حالات إنهاء الخدمة، واشترط لتحقيقها أن يعبر هذا الأخير عن رغبته في ترك منصب عمله بطلب مكتوب يدل على الإرادة الصريحة في ذلك.

Judgment is a way for nations to rise up, to be happy and to live a normal life, to support the oppressed, end injustice, cut off disputes, enjoin good and forbid evil, and strike at the hands of abusers and corrupt people in order for the system to prevail so that everyone in it is safe for himself. And then production increases and countries rise to what is right for them in their religion and their world. And then we noticed that the judiciary has ways to end the mandate in it, which are represented in isolation, isolation and resignation, and this last one that was studied is the resignation of the judge in each of the two systems: the Islamic judicial system and the Algerian legislation, in which we conclude with God’s help and success to the fact that: The resignation is an expression of expressing a desire to leave the contractual scope, but in jurisprudence it is for the judge to dismiss himself, and the Algerian legislator treated the issue of resignation from the point of view of considering it a case of termination of service, and required to achieve it that the latter expresses his desire to leave his job with a written request indicating that express will to do so.
