Abstract

إن الإشكال الدي يتناوله موضوعنا ماهوإلا تجسيد لما يعانيه الأفراد في حياتهم وعلاقاتهم الإجتماعية في عرض موجز لمتطلباتهم الضرورية وأهمها بل وجوهرها عنصر "السكن" الحق الدستوري والملازم للعيش الكريم الذي أضحى هاجسا عالميا خاصة مع ما تشهده المعمورة من تغيرات إلى الأسوأ أزكتها الأزمات الإقتصادية من جهة فلا يستطيع أيا كان أن يمتلك مسكنا نظرا للغلاء الفاحش في مواد البناء واليد العاملة معا ،وكذا الكوارث الطبيعية التي تعصف بالأبنية والسرادقات فتذهبها وتجعلها في خبر كان ومنه فإن العائلات يصير وضعها يرثى له فتشرد وتتيه في الأرض .. هذه الأسباب وأخرى جعلت من الدول والحكومات تفكر في آلية للقضاء على أزمة السكن والتخفيف من وطأتها ولو بالنذر اليسير فتوالت الصيحات في هذا الصدد وتنوعت الصيغاتفتم ميلاد عدة تشريعات لتكون أمثل طريقة تجابه مشكل السكن فكانت آخر خرجات المشرع الجزائري الذي جرى على على نهج المشرع الفرنسي ومن شاكله من القانونيين وذلك باستصداره القانون رقم01-150 والذي سبقته عدة تشريعات ولحقته عدة ترتيبات وإصلاحات وتعديلات أملا منه في أن ينال المقصود لكن هيهات.

These and other reasons made countries and governments think of a mechanism to eliminate the housing crisis and mitigate its impact, even with a small amount. The shouts in this regard and the formulas varied. Several legislations were born to be the best way to confront the housing problem. This was the last output of the Algerian legislator, who followed the approach of the French legislator and his ilk. Among the jurists, by issuing Law No. 01-150, which was preceded by several legislations and followed by several arrangements, reforms and amendments, in the hope that it would achieve what was intended, but no way.
