مسائل النكاح والطلاق وما جانسهما من فروق القرافي ترتيب البقوري

Abstract

تناولت المذكرة القواعد المتعلقة بالطلاق من كتاب الامام القرافي بترتيب الامام البقوري رحمهما الله تعالى. وذكر الامام البقوري هذه القواعد مرتبة في كتابه بعدما اختصرها وزاد فيها ما يليق بالمقام فدرسنا القواعد دراسة فقهية تأصيلية، تطرقنا إلى قاعدة الصريح من الطلاق الغير صريح مثلا وقاعدة ما يشترط في الطلاق من نية وما لا يشترط ،وقاعدة التصرف في المعدوم الدي يمكن أن يتقرر في الذمة وما لا يمكن أن يتقرر في الذمة، وقاعدة التمليك والتخيير. ومما توصلنا إليه أن القواعد التي ذكرها الامامان أنها متعلقة بعدة فروع فقهية من باب الطلاق أو من غيره من الأبواب الفقهية. وتسمح هذه الدراسة بالاطلاع على الاختلاف في مسائل الطلاق ومدى دقتها وتبحر السادة الفقهاء في معالجة الأمور الفقهية وتقريبها إلى المفاهيم البسيطة والابداع في قولبتها.

The note dealt with the rules related to divorce from the book of Imam Al-Qarafi according to the order of Imam Al-Baqouri, may God have mercy on them. Imam Al-Baqouri mentioned these rules arranged in his book after he summarized them and added what befits the position, so we studied the rules in a genuine jurisprudential study. The dhimma and what cannot be decided in the dhimma, and the rule of ownership and choice. And from what we have come to know that the rules mentioned by the two imams are related to several branches of jurisprudence, such as divorce or other jurisprudential sections. This study allows us to see the difference in issues of divorce and its accuracy, and the jurists navigate in dealing with jurisprudential matters and bring them closer to simple concepts and creativity in shaping them.
