تعد مسألة الخماسة من النوازل الفقهية عند المالكية، وهي من عقود المشاركة على الأرض، والتي أشكل الحكم فيها عند الفقهاء. فمنهم من أجازها ومنهم من منعها مع أن العمل جرى بها عند كثير من الفلاحين ببلاد المغرب قديمًا، فهي من الأمور التي تقوم بهاحياة الناس لضرورة المعاش بالرغم من مخالفتها للأصول- الإجارة بالمجهول-، ومردُّ الفقهاء في جوازها: العرف، وما جرى به العمل، فالحاجة والضرورة دعت لهذه المعاملة. وهذا من مقصد الشرع الذي جاء للتيسير ورفع الحرج بين الناس في أمورهم الدينية والدنيوية في العاجل والآجل، وبما فيه من جلب مصلحة ودفع مفسدة.
