المسألة الأمليسية في الأنكحة الأغريسية لإبراهيم الجلالي

Abstract

إن المسألة الإمليسية في الأنكحة الإغريسية هي عنوان جواب مطول مكتوب من الشيخ إبراهيم الجلالي يبدي فيه رأيه في نازلة فقهية وقعت في منتصف القرن الحادي عشر هجري , مدار موضوعها على خطبة اقترنت بها قرائن النكاح, فتخالفت فيها أقوال الفقهاء بين قائل بانعقاد النكاح ولزومه وبين قائل بالعكس وإن تلك القرائن ما هي إلا تأكيدا وتثبيتا لشأن تلك الخطبة ولا تزيد على ذلك . و لدراسة هذه المسألة الإمليسية تم بيان ماهية كل من الخطبة وعقد النكاح, وكذلك تتبع أقوال المسألة الإمليسية ودراستها دراسة فقهيه مقارنة, استدلالا وترجيحا, ثم استحضار بعض النوازل الأخرى المشابهة للمسألة الإمليسية من حيث الموضوع

" Imlissan Issue in the Grecian Marriages" is the title of a lengthy written answer from Sheikh Ibrahim Al-Jalali, in which he expresses his saying in a jurisprudential calamity that occurred in the middle of the eleventh century AH. Its subject revolves around an engagement with which the presumptions of marriage were coupled, so the sayings of the jurists differed between ones who said that the marriage took place and its necessity, and one who said the opposite, and that these evidences were only confirmation and assurance of the matter of that engagement and do not exceed that. In order to study this issue, the meaning of both the engagement and the marriage contract has been clarified, as well as following the sayings of the “Emilissan” issue and studying it as a comparative jurisprudential study, and then evoke some other views and cases similar to the issue of the Emilis in terms of the subject.
