أثر إمام الحرمين على الغزالي من خلال كتابي المستصفى وشفاء العليل

Abstract

هذا البحث عبارة عن دراسة استقرائية تحليلية مقارنة، يبحث في طبيعة العلاقة بين إمامين من فحول العلماء ومن جهابذة الأصوليين، حاولنا من خلاله الاجابة على الاشكالية المتمثلة في حقيقة تأثر الإمام الغزالي بشيخه امام الحرمين الجويني، مقلّداً ام مجدّداً؟ وذلك من خلال كتابا "المستصفى من أصول الفقه" و"شفاء الغليل في بيان الشبه والمخيل ومسالك التعليل"، حيث خلصنا إلى أن الإمام الغزالي تميز بالاستقلال الفكري، ويرجع ذلك إلى تأثره بشيخه في اعتماد الأدلة العقلية في إثبات القضايا، أكثر من اعتماده على الأدلة النقلية. كما تميز أيضاً ببعض المعالم التجديدية التي أضافها إلى علم أصول الفقه سواء من حيث منهج التأليف او العرض والترتيب والتبويب أو الأسلوب، وكذا الحدود والمصطلحات والتمثيل للمسائل والتفريعات بأدلة أخرى، غير التي يستعملها المخالف عادة.

This research is an inductive, analytical, and comparative study that examines the nature of the relationship between two imams from among the virtuosos of scholars and the geniuses of the fundamentalists. And that is through the book "Al-Mustafa from Usul al-Fiqh" and "shifa' alghalil fi bayan alshibah walmukhayil wamasalik altaelil" Where we concluded that Imam al-Ghazali was distinguished by his intellectual independence, and this is due to his influence with his sheikh in adopting rational evidence in proving cases, more than his reliance on textual evidence. It was also distinguished by some of the innovative features that he added to the science of jurisprudence, whether in terms of the method of composition, presentation, arrangement, tabulation or style, as well as limits, terminology, and representation of issues and branches with other evidence, other than what the violator usually uses.
