اثر القواعد المقاصدية في الاجتهاد التنزيلي

Abstract

يدور محتوى هذه الدراسة حولة موضوع أثر القواعد المقاصدية في الإجتهاد التنزيلي -المصلحة العامة أنموذجاً- حاولنا من خلاله إبراز دور القواعد المقاصدية في تنزيل الأحكام على النوازل المستجدة التي لا نص فيها و ذالك من خلال مبحثين , يحتوي المبحث الأول , على دراسة عامة لمصطلحات الدراسة حيث قمنا فيه بتعريفها من الجانبين اللغوي والإصطلاحي واستدلنا عليها من بعض الآيات مع ذكر لأهمية كل مصطلح وهذا كان مقسم عبر ثلاث مطالب كل مطلب حوي ثلاث فروع . و انتقلنا بعد ذالك إلى المبحث الثاني الذي تضمن صلب هذه الدراسة من خلال ذكر مجموعة من القواعد المقاصدية الخاصة بالمصلحة , و ذالك بإجراء دراسة عامة لكل قاعدة من خلال توضح معني القاعدة والاستدلال لها من الكتاب والسنة مع ذكر بعض الأمثلة أثناء هذه الدراسة . وفي الأخير خلصنا إلى خاتمة ذكرنا فيها أهم النتائج التي توصلنا إليها , وبعض التوصيات التي نأمل أن تلقي الإستجابة من الجهات المعنية .

The content of this study revolves around the topic of the impact of Intentional rules on downloading studiousness - The public interest as a model - Through it, we tried to highlight the role of intentional rules to drop judgments on New catastrophes that have no text This is done through two topic, the first topic contains a general study To terms of the study where we defined them from the linguistic and idiomatic sides and We infer it from some verses with a mention of the importance of each term This was divided into three demands, each of which contained three branches. After that, we moved to the second topic, which included the core of this study by mentioning a set of intentional rules related to the interest This is done by conducting a general study of each rule by clarifying the meaning of the rule and inferring it from the quran and Sunnah, With some examples mentioned during this study. In the end, we came to a conclusion in which we mentioned the most important results that we reached, And some recommendations that we hope to receive a response from the concerned authorities.
