Abstract: تعتبر حماية المستهلك ضمن النطاق التعاقدي ضرورة ملحة أملتها الظروف الاقتصادية الراهنة بسبب الفجوة العميقة بين المستهلك باعتباره الطرف الضعيف من حيث المعرفة الاقتصادية أو القانونية أو من حيث المعلومات الضرورية للتعاقد، والمهني الذي يمللك جميع مقومات التفوق الاقتصادي والمعرفي في العلاقة العقدية. و لعبت النظرية العامة للعقد دورا جوهرًيا في إرساء مقومات العدالة العقدية، من حيث نظرية الرضا أو مبدأ حسن النية في تنفيذ العقد التي استند إليها القضاء منذ زمن في توفير الغطاء القانوني لحماية المشتري في عقود البيع والخدمات على اختلاف أنواعها، حتى اتجهت التشريعات المعاصرة إلى إصدار تشريعات خاصة تهدف لحماية المستهلك. وكان الهدف من هذه الدراسة هو البحث عن مدى كفاية القواعد العامة في القانون المدني في توفير الحماية الكافية للمستهلك، ودور القواعد الخاصة في تفعيل هذه الحماية، الأمر الذي جعلنا نتعرض لجميع م ا رحل التعاقد بداية من تحديد مفهوم المستهلك وآليات توعيته في العقد، إلى المرحلة السابقة عن التعاقد، ثم مرحلة ابرام العقد، انتهاًء بمرحلة التنفيذ.
Consumer protection within the contractual scope is an urgent necessity dictated by the current economic conditions due to the deep gap between the consumer as the weak party in terms of economic or legal knowledge or in terms of information necessary for the contract, and the professional who possesses all the elements of economic and cognitive superiority in the contractual relationship. And the general theory of the contract played a fundamental role in establishing the elements of contractual justice, in terms of the theory of consent or the principle of good faith in the implementation of the contract on which the judiciary relied for a long time in providing legal cover to protect the buyer in contracts of sale and services of all kinds, until contemporary legislation tended to issue Special legislation aimed at protecting the consumer. The aim of this study was to search for the adequacy of the general rules in civil law in providing adequate protection to the consumer, and the role of special rules in activating this protection, which made us exposed to all stages of the contract starting from defining the concept of the consumer and the mechanisms of his awareness in the contract, to the stage Prior to the contract, then the stage of concluding the contract, ending with the implementation stage.
