المركز القانــوني للمتعاقديـن مع شركة الخطوط الجوية الجزائرية في ظل جائحة كوفيد 19

Abstract

بعد جائحة كوفيد 19 كان السؤال الأهم بالنسبة لجميع المتعاقدين عموما والمتعاقدين مع شركة الخطوط الجوية الجزائرية خصوصا باعتبارها محور بحثنا في مذكرتنا هذه ، هو ما هو المركز القانوني لهؤلاء المتعاقدين ؟ وما هو مصير عقودهم ؟ ومما سبق اكتشفنا أن شركة الخطوط الجوية الجزائرية أدرجت بعض حقوق المتعاقدين الذين ألغيت رحلاتهم : كتمديد صلاحية تذاكرهم إلى غاية 31 ديسمبر 2021 ، اللجوء إلى استرداد ثمن التذكرة ، أما في حالة رحلات الإجلاء إلى الوطن لابد أن تخضع التذاكر المخفضة والترويجية للتعديل وفقا لسعر الإجلاء المطبق يوم الرحلة حسب الإشعار الذي نشرته شركة الخطوط الجوية الجزائرية . كما وصلنا أيضا إلى أن تكييف الجائحة بأنها قوة قاهرة يختلف عن نظيرتها في حالة تكييفها بأنها مجرد ظرف طارئ، فالظرف الطارئ الذي لم يكن بالإمكان توقعه، والقوة القاهرة التي لا يمكن دفعها، يؤثران في المسؤولية العقدية سواء بتخفيفها أو بالإعفاء منها، مشيرين إلى أن جائحة كورونا تحتمل النظريتين معًا: ظرف طارئ وقوة قاهرة لما تحدثنا عن التكييف القانوني لها ذلك لأنها حادث خارجي لم يكن بالإمكان توقعه، ولا يمكن دفعه، وليس ناتجاً عن خطأ أو إهمال من جانب المتعاقدين.

After the Covid-19 pandemic, the most important question for all contractors in general and those dealing with Air Algerie, especially since it is the focus of our research in this note, is what is the legal status of these contractors? What is the fate of their contracts? From the above, we discovered that Air Algerie included some rights of the contractors whose flights were canceled: such as extending the validity of their tickets until December 31, 2021, resorting to refunding the price of the ticket, but in the case of evacuation flights back home, the discounted and promotional tickets must be subject to adjustment according to the evacuation price applied on the day The flight is as per the notice published by Air Algerie. We also found that adapting the epidemic as a force majeure differs from its counterpart in the event that it is considered as just an emergency circumstance, an emergency circumstance that cannot be foreseen, and a force majeure that cannot be paid, affecting contractual responsibility, whether by mitigating it or exempting from it, noting that the pandemic Corona holds the two theories together: an emergency circumstance and a force majeure when we talked about its legal adaptation because it is an external accident that could not have been foreseen and could not be paid, and not as a result of fault or negligence on the part of the contractors.
