النظام القانوني للصيرفة الإسلامية في الجزائر

Abstract

رغم التأخر الكبير للجزائر في مجال الصيرفة الإسلامية شهدت سنة 2020 صدور النظام رقم 20-02 المؤرخ في 20رجب1441 الموافق ل 15مارس2020 الذي يحدد العمليات البنكية المتعلقة بالصيرفة الإسلامية وقواعد ممارستها من طرف البنوك والمؤسسات المالية، وألغى النظام 18-02 الذي لم يطبق على أرض الواقع. كما صدرت التعليمة 20-03 المؤرخة في 02أفريل2020 المعرفة للمنتجات المتعلقة بالصيرفة الإسلامية والمحددة للإجراءات والخصائص التقنية لتنفيذها من طرف البنوك والمؤسسات المالية. ففي هذه الدراسة تم التطرق إلى واقع الصيرفة الإسلامية في الجزائر من خلال النصوص والأحكام الصادرة في النظام 20-02 والتعليمة 20-03، للوقوف على مدى تدارك المشرع للنقص والتأخر التشريعي في هذا المجال.

Despite the great delay of Algeria in the field of Islamic banking, the year 2020 witnessed the issuance of Regulation No. 20-02 of Rajab 20 1441 corresponding to March 15, 2020, which defines banking operations related to Islamic banking and the rules for its practice by banks and financial institutions, and abolished the 18-02 system, which was not applied on the ground. Instruction 20-03 of April 02, 2020 was also issued, which defines products related to Islamic banking, specifying the procedures and technical characteristics for their implementation by banks and financial institutions. In this study, the reality of Islamic banking in Algeria was addressed through the texts and provisions issued in System 20-02 and Instruction 20-03, in order to determine the extent to which the legislator remedy the shortcomings and legislative delays in this area.
