تسوية منازعات الملحق في تنظيم الصفقات العمومية الجزائري

Abstract

لقد اعترف المشرع الجزائري للغدارة بسلطة تعديل عقودها الإدارية في إطار ما يعرف بالملحق في مجال الصفقات العمومية وهذا خلافا لمبدأ ثبات العقد المعمول به في عقود القانون الخاص، خاصة وأن الإدارة من وراء هذه العقود تستهدف المصلحة العامة. لدى نجد المشرع الجزائري قد نص على الملحق من خلال المادة 153 من المرسوم الرئاسي رقم 15-247 يتضمن تنظيم الصفقات العمومية وتفويضات المرفق العام، إلا أن الإقرار بهذا الملحق قد ينجم عنه منازعات بين الإدارة والمتعامل معها، خاصة في حالة تجاوز المصلحة المتعاقدة حدود التعديل المقررة قانونا، الأمر الذي يجعل من تكريس ضمانات لتسوية هذه المنازعات.

The Algerian legislator has recognized the administration’s authority to amend its administrative contracts within the framework of what is known as the annex in the field of public deals, and this is in contrast to the principle of contract constancy applicable in private law contracts, especially since the administration behind these contracts targets the public interest.
