Abstract

هيئات المشاركة والطعن في مجال الوظيفة العامة يعتبر موضوع مهم وحساس في مجال الوظيفة العامة، حيث يتمكن الموظفين المشاركة في تسيير حياتهم المهنية من خلال لجان إدارية متساوية الأعضاء، ولجان الطعن، واللجان التقنية، تعتبر هذه اللجان هيئة تتشكل من عدد متساو من ممثلين عن الإدارة وممثلين منتخبين عن الموظفين وتراسها السلطة الموضوعة على مستواها او ممثلا عنها، اللجنة الإدارية المتساوية الأعضاء تعتبر من اهم الضمانات الممنوحة للموظف في مجال المساءلة التأديبية. وتختص لجنة الطعن بالنظر فيما يخص العقوبات التي تخص الموظف من الدرجة الثالثة والرابعة، اما فيما يخص اللجنة التقنية فهي تستشار في المسائل المتعلقة بالظروف العامة للعمل، وكذا النظافة والأمن، داخل المؤسسات والإدارات العمومية. خصص المشرع هذه اللجان لحماية الموظف، ومنحه الفرصة للمشاركة في تسيير حياته المهنية، وزرع الثقة والديمقراطية بين الموظف والإدارة، والتعاون على ما يخدم الإدارة.
