الفئات المعنية بالحماية في القانون الدولي الانساني

Abstract

يتضمن هدا البحث جملة من الحقوق التي ضمنها القانون الدولي الانساني لبعض الفئات والتي هي الجرحى والمرضى والاسرى والمدنييين ...الخ ، وكدالك تم عزو ما يقابلها من الحقوق في الشريعة الأسلامية وما انفردة به الشريعة الأسلامية عن القانون الدولي وما انفرد به القانون الدولي عنها ،كما تم التطرق الى وضع تعاريف وحدود للمفاهيم الاساسية فى البحث وتوثيق المعلومات من الجانب القانوني من مصادرها الأساسية اهمها الاتفاقيات والبروتوكولين واهم ماوثق به في الجانب الشرعي الكتاب والسنة ،ولقد تم تبيين فضل اسبقية الشريعة على القانون الدولي وفضل مأسسة وتطوير القانون الدولي على السرعة الاسلامبة .

This research includes a set of rights guaranteed by international humanitarian law for some groups, which are the wounded, sick, prisoners, civilians ... etc، Likewise, the corresponding rights were attributed to Islamic law, as well as what Islamic law is unique to from international law and what international law is unique to it،They also dealt with setting definitions and limits for basic concepts in research and documenting information from the legal side from its main sources, the most important of which are the agreements and protocols, and the most important documented in the Sharia side, the Book and Sunnah. The preference for the precedence of Sharia over international law has been demonstrated, and the preference for institutionalization and development of international law over the proper speed key words:Categories 'Protection' International Humanitarian Law 'Peaceful Jurisprudence' Sick and Wounded 'Captives' Civilians 'Women' Children.
